Our commission recently held a NOI hearing for construction of a single family home. A number of abutters were in attendance & the direct abutter is disputing the property boundaries & has hired an attorney. The abutter has a deed stating that the land in question is theirs. The engineer did not have any documentation with him re: the ownership of the land. The commission continued the hearing to allow time to resolve the boundary dispute. The engineer feels that the hearing should be closed & an OoC issued because if the outcome of the dispute proves that the applicant does not own the land, the OoC would be null & void & a new NOI would have to be filed.

Has any other commission experienced a similar problem? If so, how was it handled?
