The Monson Commission has noticed more than one error on USGS maps that have shown solid lines that turned out to be intermitent brooks, and dashed lines that are clearly perenial streams. I would think that with the local knowledge of your commission you should be able to overcome the presumption that the USGS map is accurate as to stream flows being intermitent. Is DEP still saying that a stream with over 1 square mile of watershed area is presumed to be perrenial? And even if the applicant is saying he has seen it dry, you may want to take into account that we are in a drought advisory condition! Things are VERY dry in our area. Has the applicant sufficeintly documented the "dry" stream bed with photos? Even photos may not be valid under a drought advisory condition.
