Three different sets of rules apply:
1) Bordering Land Subject to Flooding (BLSF) contained in the Wetlands Protection regulations (see 310 CMR 10.57) enforced by the Conservation Commission. Compensatory storage is required for all flood storage volume that will be lost as a result of the proposed project when it the judgement of the issuing authority said loss will cause an increase or will contribute incrementally to an increase in the horizontal extent and level of flood waters during peak flows.
2) State Building Code regulations for construction in a floodplain enforced by the Building Inspector.
3) The floodplain bylaw your town has as a condition of participating in the National Flood Insurance Program. The local floodplain bylaw must be consulted to see if any additional requirements apply.
In addition, you should check to see if any portions of the proposed project are located in other areas subject to the Conservation Commission's review, including, but not limited to, Riverfront Area and buffer zone to a bank.
