The Wetlands Protection Act does not make the distinction. That is why Wetland Replication is allowed - if man-induce situations were not wetlands than there could never be no net loss. Wetlands are defined by the vegetation and/or presence of Hydric soils. Just because water ponds in an area does not mean that that the duration of the water is long enough to support wetland indicator plants - and it will take even longer for the soil morphology.
