We have used the surficial geology maps and physical observations to refute the USGS Maps. If the stream is in an area of stratified drift (i.e., sands and gravels), appearing an disappearing streams are common and periennial. DEP is still fighting for the 1 sq. mi., the official policy is still 3. Also check for tributaries. A second order stream will add weight to your arguement.
